Ligji nr 112/2020 “Për regjistrin e pronarëve përfitues” është miratuar nga parlamenti në korrik të vitit 2020 me inisiativë të këshillit të Ministrave. 11 deputetë votuan kundër ligjit.
Prej atëherë ligji 112/2020 për “Regjistrin e pronarëve përfitues” është amenduar dy herë.ndërsa janë lëshuar dy vendime të këshillit të ministriave që lidhen me zbatimin e ligjit. Edhe vendimet e mësipërme janë amenduar në vijim me tri vendime të tjera cfarë shpreh një dinamikë të gjerë të ndryshimeve në ligj për shkak të sfidave që janë hasur përgjatë aplikimit të ligjit dhe vendimeve të Këshillit të Ministrave.
Qëllimi i ligjit është identifikimi i pronari përfitues, i cili është i fundit në pronësi ose ushtron kontrollin e fundit efektiv ndaj një personi juridik (subjekt tregtar dhe OJF), të regjistruar në Republikën e Shqipërisë dhe identifikuar me NUIS/NIPT.
Justice institutions are financed from the State Budget or other legal sources[1], while budget planning is carried out by Justice institutions. The budget is voted and approved by the Parliament.
The High Judicial Council (KLGJ) is charged by law no. 115/2016, 3.11.2016 “For the governing bodies of the justice system” [2] to propose the budget for the judicial system, while KLGJ also administers and controls the budget of country's courts. Before the reform, the administration and budgeting was carried out by a budget administration office, reporting to a board headed by the chairman of the Supreme Court.
The judicial system[3] in the country includes 13 courts of General Jurisdiction of the First Instance; 1 Court of Appeal of General Jurisdiction; 1 Special Court of First Instance for the trial of criminal offenses of corruption and organized crime, 1 Special Court of Appeal for the trial of criminal offenses of corruption and organized crime; 2 Administrative Courts of First Instance, 1 Administrative Court of Appeal; 1 Supreme Court[4]
In the courts, the budget is now approved by the Council of the Court. Meanwhile, the General Prosecutor's Office monitors the budget of the country’s prosecutors’ offices.
The budget prepared and managed by Justice institutions has an internal monitoring by the structure responsible for the performance of the budget. The structure of financial management is set up in each court, while its size depends on the category of courts. The monitoring reports are prepared according to the relevant instructions of the Ministry of Finance[5].
